Terms of Service

These Terms govern your use of the 24/7 Mom mobile app and web app, operated by Batoom LLC. By creating an account or using the Service, you agree to these Terms.

These Terms of Service (“Terms”) govern your use of the 24/7 Mom mobile app and web app (together, the “Service”), operated by Batoom LLC (“we”, “us”, “24/7 Mom”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance & eligibility

You must be at least 18 years old to create a 24/7 Mom account. The Service is intended for adult parents and caregivers managing their household.

By creating an account, you represent that:

  • You are at least 18 years old.
  • The information you provide is accurate and current.
  • You have the legal authority to provide information about other members of your household (spouse/partner, children) and to authorize 24/7 Mom to use that information for the purposes described in our Privacy Policy.

2. Your account & responsibilities

You are responsible for:

  • Maintaining the security of your sign-in credentials (we use Clerk for authentication; treat your Google/Apple sign-in like any other credential).
  • All activity that occurs under your account.
  • Keeping your contact and household information accurate.
  • Notifying us promptly at support@247mom.ai if you suspect unauthorized access to your account.

We may suspend or terminate your account if you violate these Terms, abuse the Service, or use it in a way that creates risk for us or other users. See Section 10.

3. Acceptable use

You agree NOT to use the Service to:

  • Violate any law or third party’s rights.
  • Impersonate any person or misrepresent your relationship to another person whose data you provide (including children).
  • Access another user’s account or data, or attempt to bypass security controls.
  • Reverse-engineer, decompile, or attempt to extract source code from the app or our agent runtime.
  • Use the Service to send spam, harass, harm, or defraud other people via the connected services (Gmail, etc.) we operate on your behalf.
  • Use the Service for any unlawful, deceptive, or harmful purpose.

We may remove content or actions taken via the Service that violate this section, and we may suspend or terminate accounts that repeatedly violate it.

4. Connected services

The Service offers optional integrations with third-party services, including Google (Gmail, Calendar), Apple (iCloud Calendar, Apple Health), your device’s built-in calendar, your school’s Canvas or other Learning Management System, Oura, WHOOP, Instacart, DoorDash, Crossmint, and retailer catalogs such as Amazon and Walmart. When you connect a third-party service:

  • You grant 24/7 Mom permission to act on your behalf within that service, scoped to the specific grant you authorize. The exact scopes are listed in our Privacy Policy.
  • You retain ownership of the data those services hold. 24/7 Mom does not assert ownership over your Gmail messages, Calendar events, health metrics, or LMS records.
  • You may disconnect any connected service at any time via Settings. We will revoke the access token where the provider supports a revoke endpoint and stop using the corresponding data.
  • The third-party service has its own terms and privacy policy that you agreed to when you signed up for it; those continue to apply.
  • We are not responsible for actions or outages of third-party services, but we will surface relevant errors to you.

5. Artificial intelligence

The Service is built on large language models operated by third parties, including Anthropic, OpenAI, and Google. To answer your questions and take actions, we send those providers a prompt that can include your chat history, household and children’s details, calendar entries, email contents, and health context. Our Privacy Policy describes this in detail under “How the AI works, and what it receives,” and we ask for your explicit consent to it during onboarding.

If you upload a photo to generate a family avatar, that photo is sent to an image-generation provider for that single request and is not stored by us.

You can withdraw consent by disconnecting the relevant service or deleting your account. The Service cannot function without sending data to a model provider, so withdrawing this consent means discontinuing use of the Service.

6. Purchases, payments, and agent spending

Some features of the Service involve money. Read this section carefully — parts of it describe an AI agent acting on your behalf.

6.1 What we are, and are not

Except where expressly stated, 24/7 Mom is not the seller, merchant of record, or fulfillment partner for anything you buy. We surface options, prepare carts, and where you authorize it, complete a purchase on your behalf with a third-party merchant. The merchant’s own terms govern the order, payment, delivery, returns, and warranty.

6.2 Agent-assisted purchasing

Agent-assisted checkout is currently offered to a limited group of pilot participants and is not available to all users. Where it is available to you, you may grant the agent a standing authorization to make purchases on your behalf using a payment card you enrol with our payment processor. If you do:

  • You set a monthly limit. When you enrol a card you authorize a maximum monthly spend. That limit is registered with our payment processor, which declines charges above it. We apply an additional per-purchase ceiling of our own before submitting any order.
  • You may revoke the authorization at any time, without notice or reason, by contacting us at support@247mom.ai or by deleting your account, which removes it automatically. Revocation stops us from initiating further purchases; an order already submitted to a merchant must be cancelled or returned through that merchant.
  • You remain responsible for purchases made within the limits you set, in the same way you would be for a purchase you made yourself. This is what a standing authorization means.
  • You are not responsible for purchases made outside those limits. If the agent completes a purchase that exceeds a limit you set, that you did not authorize, or that we failed to decline when we should have, contact us at support@247mom.ai and we will work with you and the merchant to cancel or reverse it. Where the charge cannot be reversed and the failure was ours, we will make you whole for the amount charged.
  • Report problems promptly. Tell us within 60 days of the charge appearing so we can act while the merchant’s own dispute window is still open.
  • AI systems make mistakes. The agent can misread a product, quantity, price, or your instruction. Review what the agent proposes before you authorize it, and review your order confirmations.

6.3 Disputes and refunds

Refunds, returns, and chargebacks are handled by the merchant that sold you the item, under that merchant’s policy. We will provide the transaction records we hold and help you open a dispute, but we cannot compel a merchant to issue a refund. Nothing in this section limits any right you have against your card issuer.

6.4 Stablecoin payments

Where the Service facilitates a purchase paid in stablecoin (e.g., USDC), the transaction is processed by Crossmint. Crossmint is the payment processor; we receive a record of the transaction so we can show you order status. You are responsible for understanding the nature of stablecoin payments, including that on-chain transactions are typically irreversible and may not be recoverable if sent in error.

6.5 Instacart and other handoffs

When you convert a shopping list into an Instacart order, the Service generates a shareable Instacart URL. You transact with Instacart directly, not with 24/7 Mom. Instacart’s terms apply to the order, payment, and delivery. The same applies to other retailer links we surface.

6.6 Affiliate compensation

Some retailer links we surface carry an affiliate code, and we may earn a commission if you complete a purchase through one. This does not change your price, and it does not influence what the agent recommends — product and retailer selection is driven by your request and your saved preferences, not by which link pays us.

6.7 Subscription

The Service does not currently charge a subscription fee. If we introduce paid subscriptions, we will update these Terms with the pricing, billing method, auto-renewal, cancellation, and refund details, and you will be asked to agree before any charge applies.

6.8 Payment credentials

We do not store full credit-card numbers, bank-account details, or wallet private keys. Cards enrolled for agent-assisted checkout are held by our payment processor; we retain only a vaulted reference, the card brand, and the last four digits.

7. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any information generated by the agent is accurate or complete.

Specifically:

Not medical advice

Information the agent provides about health, sleep, wellness, or any other medical topic is for general informational purposes only. It is not a medical diagnosis and is not a substitute for advice from a licensed healthcare professional. Always consult a doctor for medical concerns. The Service is not a medical device.

Not legal advice

Anything the agent says about legal matters (custody, school enrollment, contracts, immigration, etc.) is informational only and is not legal advice. Consult a licensed attorney for legal matters.

Not financial advice

Anything the agent says about budgeting, taxes, investments, or stablecoin purchases is informational only and is not financial advice. Consult a licensed financial advisor for financial matters.

AI outputs may be wrong

The Service uses large language models that can produce inaccurate, incomplete, or unexpected outputs. Always verify important information (dates, addresses, dosages, prices, dietary safety) before acting on it. The Service may extract events from your email and create calendar entries; you are responsible for confirming those entries are correct.

Children’s safety information

Allergy data and other safety-critical information you provide about a child is treated as the source of truth — but you remain responsible for confirming any meal, product, or activity recommendation is safe for the specific child it concerns.

8. Limitation of liability

Limitation of Liability. To the maximum extent permitted by applicable law, Batoom LLC’s total cumulative liability arising out of or relating to these Terms or the 24/7 Mom service shall not exceed the greater of (a) the total fees paid by the user to Batoom LLC in the twelve (12) months immediately preceding the claim, or (b) one hundred U.S. dollars ($100). In no event shall Batoom LLC be liable for indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility of such damages.

This limitation does not apply to our obligations under Section 6.2 regarding purchases made outside the limits you set.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Your content and data

You retain ownership of the content you provide and the data we receive on your behalf. You grant us a limited licence to process it solely to operate the Service as described in our Privacy Policy. We do not sell your data, use it for advertising, or permit model providers to train on it.

10. Termination

By you. You may terminate your account at any time via Settings → Delete account. Doing so triggers the deletion cascade described in our Privacy Policy: your account and the data associated with it are removed from our systems, your OAuth grants are revoked where the provider supports revocation, your generated avatars are deleted from storage, your agent container and its memory are destroyed, and your Clerk identity is deleted. We retain only a minimal record that the deletion occurred, as described in the Privacy Policy.

By us. We may suspend or terminate your account at any time, with or without notice, if you:

  • Violate these Terms.
  • Use the Service in a way that creates legal or security risk for us or other users.
  • Pose a danger to other people through the Service (including through connected email or messaging features).
  • Fail to pay amounts due (if and when subscriptions are introduced).

We will, when reasonably possible, give you notice and an opportunity to export your data before terminating.

Effect of termination. On termination, your access to the Service ends. The data-deletion behavior described above applies whether termination is initiated by you or by us.

11. Changes to these Terms

We may update these Terms from time to time. For material changes we will notify you in the app or by email at least 30 days before the change takes effect. The most recent version is always available at www.247mom.ai/terms. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

12. Dispute resolution — arbitration and class action waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the 24/7 Mom service, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except where prohibited by applicable law.

Class Action Waiver. You and Batoom LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action, class arbitration, or representative action against Batoom LLC, except where such waiver is prohibited by applicable law.

Opt-Out Right. You may opt out of this arbitration and class action waiver clause by sending written notice to support@247mom.ai within 30 days of first accepting these Terms. Opting out will not affect any other aspect of your relationship with 24/7 Mom.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters relating to intellectual property, security, or unauthorized access.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
